Administrative Separations and Boards of Inquiry
Although called “administrative” in nature, separations boards, including Boards of Inquiry for Officers, are in reality quite punitive, and carry penalties which can have a profound effect on the rest of servicemembers’ lives. At these hearings, servicemembers face the possibility of being kicked out of the military with an Other than Honorable discharge and a negative re-enlistment code. Not only will this discharge follow you for the rest of your life, but again you can lose nearly all benefits that you worked so hard to gain. Both Administrative Separations hearings and Boards of Inquiry give the servicemember the chance to fight to remain in the military, receive the honorable discharge you deserve, and in the case of retirement eligible servicemembers, to argue that a reduction in grade for purposes of retirement is not appropriate.
These issues are not only complex, but the stakes are also extremely high, which is why coloring them with the “administrative” title is deceiving. Krystal Capasso Law is here to fight for you through this process. As former former active duty military attorneys, we know the ins and outs of this system and will help to ensure that your rights, benefits, and retirement are protected.
